A GUIDE FOR ACCUSED PERSONS, INCLUDING SELF-REPRESENTED AND UNREPRESENTED INDIVIDUALS

The purpose of this Guide is to provide you with all the information that you require for remote “remand” court appearances scheduled for the following locations:

  • St. Catharines Courtroom #3
  • Welland Courtroom #2
  • Fort Erie Courtroom #2

Do not attend the Courthouse in person. You can attend over the Internet or by telephone. Directions are given below.

Keep this guide; you will need it for all your remote court appearances.  Remote means you are not required to attend court in person. 

At this time criminal case management appearances will be conducted by videoconference or audioconference.

Unless you have signed an Enhanced Designation with a lawyer you are responsible to attend virtual court yourself.  If you fail to attend virtual court, a bench warrant may be issued for your arrest.

BEFORE YOUR COURT APPEARANCE

Contact the Crown Attorney’s Office for your disclosure and Crown Screening Form.

 

If you have a personal email address where you can receive confidential material, send an email request to:

 

 

  • Once you have reviewed your disclosure and Crown Screening form you need to decide if you are going to hire a lawyer privately, or apply for Legal aid, or represent yourself.
  • If hiring a lawyer privately please contact them in advance of your Appearance date and provide them with your disclosure and Crown Screening Form. Unless you have signed an Enhanced Designation – it is still your responsibility to video/call in at your designated time.
  • If applying for Legal Aid - follow instructions in the next section of this notice.  You still need to call/video in at your designated time.
  • If you have decided to represent yourself (and will not be hiring a lawyer, nor obtaining Legal Aid) you should call 905-685-4293 (St. Catharines) or 905-732-1327 (Welland & Fort Erie) to obtain a copy of your Trial Time Estimate Form (TTEF). This form can then be used to schedule a Judicial Pretrial (JPT).  The purpose of a Judicial Pretrial would be to discuss potential resolution or details about how the trial would run to assist in setting a trial date.  This Judicial Pretrial would be scheduled in a courtroom before a Judge with an Assistant Crown Attorney present. Note that the Assistant Crown Attorney’s cannot give you legal advice, nor are your discussions confidential as they are not your lawyer.   • If your matter is being prosecuted by the Federal Crown please contact: admin@angerlaw.ca.   Please leave your name and court date.
CONTACT LEGAL AID IF YOU DON'T HAVE A LAWYER

Please contact Legal Aid Ontario well in in advance of your court appearance.

If you would like general legal advice, or if you want to apply for legal aid, call the central Legal Aid Duty Counsel number at 1-800-668-8258.

If you want to speak to a local Duty Counsel, who may provide legal advice and/or assist eligible individuals with their court appearance, you may contact the local duty counsel office at 905-685-8695.  At this time local Duty Counsel cannot guarantee same day assistance. Leave a message with your name and a telephone number you can be reached at.

Before calling Duty Counsel, please request your disclosure (evidence in your case) and Crown Screening Form (see next section)

 
REQUESTING DISCLOSURE FROM THE CROWN'S OFFICE

If you have been charged with an offence under the Criminal Code of Canada, the Controlled Drugs and Substances Act (such as illegal possession or trafficking of a drug) the Youth Criminal Justice Act, or another federal criminal offence (such as excise tax or income tax offence) email your request to:

If you do not have photo identification or access to a secure personal email address, please call the Public Prosecution Service of Canada Office at admin@angerlaw.ca  or call 905-688-4520 to arrange for disclosure to be provided to you in another way.  Please leave your name and court date.

 

 ATTENDING REMOTE COURT (Starting SEPTEMBER 8, 2020)

Please know your phone number. Write it down before you call in.

You are encouraged to call at the beginning of your scheduled time.

Lunch will be scheduled daily from 1:00 pm to 2:00 pm and breaks will be taken at the discretion of the presiding Justice of the Peace

For Wednesday and Friday morning matters: All matters start at 9:00 am

You can attend court either over the internet, or by phone
